Work Order, Bill of Quantities, Work Completion Certificate indicating the total value of the work done inclusive of all deviations and escalations against the subject work and including all taxes & duties, but excluding Goods & Service Tax (GST). In case of work executed outside VSP, and where the total amount includes GST, tenderers shall make efforts to get the value of GST indicated separately in the Work Completion Certificate

ii) In case of work-in-progress, Work-in-progress Certificate indicating start date as per Order and actual start date & value of work executed with date up to which it is considered against the subject work and including all taxes and duties , but excluding Goods & Service Tax (GST) with certification of satisfactory performance of the Contractor to that extent and continuance of the said work by the respective employer

Para(ii) above is NOT APPLICABLE for JOB CONTRACTS

The value of Work Completion / Work-in-progress on or before ending last day of month previous to Tender Notice date shall only be considered

9 E-RFX SUBMISSION PROCEDURE - 2 PART:

RINL is employing SAP SRM 7.0 for Electronic Tendering System. E-RFx Response to be submitted electronically through System only. No physical paper/print needs to be submitted. Bidders need to have UserID and Password to part icipate in SRM E-Tenders. All enlisted vendors of RINL would be provided User ID and password for participating in RINL E-Tenders. If a Bidder who wish to participate is not presently enlisted with RINL or not having User ID Password can obtain the same thr ough Registration of Suppliers (RoS) system by providing requisite details well before the RFx Submission deadline. Bidders to go thr ough the User Manual of RoS system available in SRM Portal for detailed steps for obtaining User ID & Password.

In 2-Part E-RFx, Technical RFx Response is uploaded to PQC/Tech RFx cFolder and Price RFx is quoted in Biding Engine.

E-Tendering User Manual available in SRM Portal contains the procedure participating in RINL E-Tenders.

Bidders to ensure the following before submitting the 2-Part E-RFx Response

a. All Mandatory questions are answered and Requisi te documents areuploaded into PQC cFolder including Bid Security Declaration andUndertaking letter.

b. All Techno-Commercial documents required as per tender document are uploaded into "Tech RFx" cFolder.

c. Prices and Taxes (Conditions) are quoted in the bidding engine.

Then upon ensuring confirmation of RFx response is complete and contains no errors, RFx Response to be Submitted.

Bidders to ensure that E-RFx Response submission is done before"Submission deadline date & Time" indic ated in the NIT Key informationat 2 above. RFx can be "withdrawn" and modified as long as "Submission deadline date & Time" is not over. RFx Response cannot be modified once Submission deadline time passed.

10 E-RFX OPENING PROCEDURE - 2 PART:

E-RFx Responses are opened in the system Electronically.

System allows opening of RFx responses only after t he specified date and Time as indicated at 2 Key in formation above. Authorized Tender opening officers through the process of "Simultaneous Log-on" shall open the RFx Responses in System.

For 2-Part E-RFx first "PQC" & "Tech RFx" cFolders are opened in the system through Simultaneous Log -on Process. Then Price RFx responses opening event will be executed on a s pecified Date & Time through Simultaneous Log-on process for Techno-Commercially Accepted Responses on intimation to Bidders.

11 DOCUMENTS TO BE UPLOADED IN TECH BID C FOLDER:

**Note: Documents submitted in “Notes & Attachments” folder will not be considered for evaluation The agency can submit the following:

A) Bid Security Declaration as per Annexure attached is to be submitted OR

B) UDYAM Registration Certificate issued by Ministry of MSME.

If the documents mentioned at either Para(A) or Par a(B) are not submitted in full in all respects, th ese documents shall not be sought and the bid will be REJECTED

The files uploaded in Tech_bid folder as current version only will be considered for evaluation C)Signed Undertaking letter on the agency's letter head in the formatgiven in the tender schedule D) PQC related Statutory Documents to be submitted, wherever required

i) Electrical License (For Electrical contracts) as mentioned at para-5 above

iii) Competency Certificate issued by Director of F actories, AP For Persons competent to carry out Ins pection & Certification of Lifting Equipments, Pressure Vessels and Elevators etc

E) Agencies Copy of registration letter issued by V .S.P. in case of registered agencies and in case of non-registered agencies, either a copy of Notarized Sole Proprietorship Affidavit OR a copy of Notarized Partnership Deed along with Fir m Registration Certificate OR a copy of Memorandum of Association & Articles of Association along with certificate of incorporation – whichever is applicable.

G) Work Order(s) and Work Completion Certificate(s) / Work-in-progress certificate(s) as indicated at Clause-5 above.

H) INTEGRITY PACT: (Applicable for estimate value of one crore and above)

(i) Tenderers are required to unconditionally accept the “IntegrityPact” enclosed to the tender document and shall submit the same duly signed along with their offer. Offer of the tenderers received without Integrity Pact duly signed, shall not be considered.

(ii) The details of External Independent Monitors (EIMs) and Nodal Officer of RINL are placed to VSP website (www.vizagsteel.com) at Tenders->Works Contracts->General Instructions-> Click here ‘to Read Integrity Pact’ / to Give Vigilance Complaints ’ ->Integrity Pact VSP

VSP reserves the right to reject the offer in case the required documents are not submitted.

Note : (i) Tenderers shall submit GST Registration Certificate under GST act if available. If not avai lable, successful tenderer shall produce Registration Certificate under GST Act, wherever applicable, before signing the Work Order / Letter of Acceptance and submit a copy of the same.

(ii) Tenderers shall submit the PF Registration Certificate if available, if not available successful tenderer shall submit PF Registration Certificate before commencement of the work.

Documents mentioned at 11(E) to 11(G) are applicable for Open Tenders /LTE cases only 12 E-RFX EVALUATION PROCESS:

(a) Pre-qualification evaluation shall be done based on the documents submitted by the bidders in PQC & Tech RFx cFolders.

(b) All the RFxs shall be evaluated on the basis of landed cost only which includes all taxes and duties but excluding Goods & Service Tax (GST).

(c) TAL1 (Technically accepted L1) price arrived by the system shall follow automatically to Auction d ocument as start bid price for all cases of Reverse Auction and will be visible in the system only after the start time of Live Auction (E-Reverse Auction).

(d) On completion of Live Auction, composite compar ative statement is generated by the system consider ing the RFx Prices and Reverse Auction Prices. Placement of Order shall be considered on the L-1 price so arrived.

(e) Notwithstanding anything specified in this tend er documents, RINL, in its sole discretion, uncondi tionally and without having to assign any reason, reserves the following rights:

(i) To reject the response whose performance is poor in awarded / ongoing works if any.

(ii) To give purchase preference to Public Sector Undertakings wherever applicable as per Government Policy / Guidelines

(iii) To extend purchase preference to Local MSEs ( Micro & Small Enterprises) as per prevailing guidel ines of RINL subject to submission of documents as stipulated in Detailed Terms & Conditions of NIT.

13 REVERSE E-AUCTION PROCESS:

In case RINL wishes to conduct Reverse auction, the same shall be communicated to all the techno comme rcially qualified bidders at an appropriate time.

The Auction shall be conducted on SAP SRM LIVE AUCT ION PLATFORM. All technically and commercially acce ptable bidders would be required to participate in the reverse e-auction and quote from the start Price.

Bidders would be required to quote single price i.e price net of ITC on GST.

No separate User ID and Password is required for pa rticipating in Live Auction. User ID and Password u sed for Participating in E-Tendering to be used for Live Auction also.

(a) AUCTION TIME EXTENSION:

1. Throughout the Auction process, Bidders should k eep in view the ‘Time Remaining’ that appears on the ‘Live Auction cockpit’ screen and submit their Bids well within the time that gets displayed therein.

2. Bidders to note that System calculates Auction End time during the Auto extension period as under:

If any of the bidder, submits a valid price, in the last “X” minutes, the system will extend the Auction End time to “Existing End Time + Y minutes”. This will be done “N” number of times.

The Auction time extension is explained below with an example.

Example: Reverse Auction conducted with Auction parameters as:

AUCTION SCHEDULE: 11.00 AM to 12.00 noon, REMAINING TIME TRIGGER: 4 minutes and EXTENSION TIME: 5 minutes The current Auction End time being 12:00 and in cas e a bid is submitted by any bidder after 11.56 AM. (in the ‘Remaining Time Trigger’ i.e., in the last 4 minutes ) of the auction, the auction end time gets extended up to 12.05 PM (12:0 0 plus 5 Min.). Hence the new end time of the Auction is 12.05 PM. However, I n case a bid is submitted prior to 11:56 i.e., befo re the ‘Remaining time trigger’, Auction shall not get extended and the same gets closed at 12:00.

Further, during the Auto extension period of the Au ction, if a bid is submitted by any bidder after 12 .01 PM. (in the last 4 minutes) of the auction the auction end time gets extended up t o 12.10 PM. (12:05 plus 5Minutes). In case the bid is submitted by any bidder from 12.00 to 12.01 PM, auction end time will not get ex tended because it is not within the period of REMA INING TIME TRIGGER of 4 minutes and Auction end time shallbe 12:05.

Important Note :

Bidders have to ensure continuous internet connecti on during the live auction. If the bidders' interne t connection gets disturbed,the details in the auction window will not get refreshe d upon fresh bids in the auction. Bidders cannot se e the latest bids submitted in the auction after the disconnection. If a bidder’s Rank is 1 for any item, it will continue to remain as 1 in their screen even if other bids are submitted in the auction if internet connection is not proper/disturbed. Even the time remaining wil l continue to reduce. It is the responsibility of the bidder to maintain the uninte rrupted internet connection during live auction. Since auto refresh is not possible during disconnection, click F5 button in your key board to refresh the auction screen . If proper in ternet connection exists Bidder’s screen gets refreshed else if there is any connection problem

Bidder will get error screen/message upon pressi ng F5. If Bidder gets error screen, bidder should login again and come back to Auction cockpit after restoring proper internet connection to view the latest status in the auction cockpit. It is advisable to click on F5 frequently and every 20 seconds during extension ti me to manually refresh the live-auction cockpit scr een. RINL does not accept any responsibility for issues related to non-participation due to internetconnection problems at vendor’s end.

14 GENERAL INSTRUCTIONS:

1) The documents submitted by the tenderers in resp ect of pre-qualification evaluation criteria are final and no further correspondence / clarifications / submissions in this regard shall be entertained.

2) Scope of work, Bill of Quantities (BOQ), Terms a nd Conditions, given in the tender documents(placed in the cFolder Publisher area) is final. On verification, at any time, wheth er the tenderer is successful or not, if any of the documents submitted by the tenderer including the documents downloaded from our website are found tampered /altered/ incomplete, they are liable for actions like rejection of the tender, cancellation and termination of the contract, debarring etc., as per the rules of the company.

6) Tenders submitted against the NIT / Tender shall not be returned in case the tender opening date is extended / postponed. Tenderers desirous to modify their offer / terms may submit their revised / supplementary offer(s) within the extended TOD.

7) VSP after opening of tender/bid document may see k in writing, documents/ clarifications which are n ecessary for evaluation of tender / bid document from the Tenderers/ bidders o r issuing authority for confirmation of eligibility/ pre-qualification stipulated in the NIT.

8) If it comes to the notice of VSP at any stage ri ght from request for registration/ tender document that any of the certificates/documents submitted by applicant for r egistration or by bidders are found to be false/ fa ke/ doctored, the party will be debarred from participation in all VSP tenders for a period of 05(FIVE) years including termination of contract, if awarded. Security Deposit if any will be forfeited. The contracting agency in such cases shall make good to VSP any loss or damage resulting from such termination. Contracts in operation anywhere in VSP will also be terminated with attendant fall outs l ike forfeiture Security Deposit, if any, and recovery of risk and cost charges etc.,Decision of V.S.P Management will be final and binding.

9) The date of opening of the PQC and Tech RFx response shall be the date of tender opening.

10) Successful tenderer should be in a position to produce, after opening of the price bids, the Origi nal Certificates in support of the attested copies of relevant documents submitted along with tender document. Failure to produce the ori ginal certificates at this stage in support of the attested copies of Electrical License/ any other documents etc. submitted earlier would result in disqualification and also liable for debarring from participation in VSP tenders.

11) RINL will not be responsible for any delay/ los s/ any website related problems in downloading the tender documents etc. RINL reserves the right to (A) Split and award the work to more than one agency, (B) Reject any or all the tenders or to accept any tender wholly or inpart or drop the proposal of receiving tenders at any time without assigning any reason thereof.

12) The punitive action of debarring the agency for a period of 3(Three) years for the reasons mention ed in the Bid Security Declaration shall supersede the related clauses of Special Conditions of Contract (SCC) as given below:

(a) Withdrawal/modification of bid after tender opening and during the period of bid validity stipulated in the tender document or any extension thereof (Clause No.27 of SCC)

OR

(b) Having been notified of the acceptance of the Bid by RINL, during the period of bid validity, if the agency (i) Fail or refuse to execute the Contract.

(or) (Clause No.31 of SCC)

(ii) Fail or refuse to furnish the security deposit , as stipulated inthe Tender Document/ Work Order/ Letter of Acceptance/ Purchase Order Clause No.33 of SCC)

13) Planning and Designing in purview of Vulnerability Atlas of India:

a. Vulnerability Atlas of India (VAI) is a comprehe nsive document which provides existing hazard scena rio of the entire country and presents the digitized State/UT-wise hazard, maps with respect to earthquakes,winds and floods for district-wise identification of vulnerable areas.It also includes additional digit ized maps for thunderstorms, cyclones and landslide s. The main purpose of this Atlas is its use for disaster preparedness and mitigation at policy planning and project formulation stage.

b. This Atlas is one of its kind single point sourc e for the various stakeholders including policy mak ers/ administrators/ municipal commissioners/ urban managers/ engineers/ architect s/ planners/public etc. to ascertain proneness of a ny city/location/site to multi-hazard which includes earthquakes, winds, floods, thunderstorms, cyclones and landslides. While project formulation, approvals and implementation of various urban housing, build ings and infrastructures schemes, this Atlas p rovides necessary information for risk analysis and hazard assessment.

c. The Vulnerability Atlas of India has been prepar ed by Building Materials and Technology Promotion C ouncil under Ministry of Housing and Urban Affairs, Government of India and available at their website www.bmtpc.org.

d. It is mandatory for the bidders to refer Vulnera bility Atlas of India for multi-hazard risk assessment and include the relevant hazard proneness specific to project location while planning and designing the project in terms of:

I.Seismic zone (II to V) for earthquakes

II.Wind velocity (Basic Wind Velocity: 55,50,47,44,39 and 33 m/s) III.Area liable to floods and Probable max. surge height

IV.Thunderstorms history

V.Number of cyclonic storms/ severe cyclonic storms and max sustained wind specific to coastal region VI.Landslides incidences with Annual rainfall normal

VII.District wise Probable Max. Precipitation

14) Bidders are required to check for any Corrigend um(s) issued till the bid submission date and time in www.vizagsteel.com or www.eprocure.gov.in

15 INSTRUCTIONS TO TENDERERS ON E-TENDERING/E-AUCTION:

For use of the RINL e-procurement (SRM) system and before submitting bid, a Vendor/Bidder should und erstand the e-tendering process by going through user manual which is available in our portal https://srm.vizagsteel.com and the NIT of related tender(RFx).

Vendor is responsible for all the necessary require ments including infrastructure in proper condition i.e. Computer, operating system and software platform (including browser) , antivir us, network connectivity, internet services, uninte rrupted power supply to computer or networking equipment etc., availability of correct user id and password etc so that the participation in the RFx and/or auction during e-procurement process is not affected. Any interrup tion at vendor’s end due to non-availability of the above faciliti es will not be entertained as reason for review of the RFx and/or Auction participated or intended for participation by the Vendor.

Understanding the bidding method and entry of corre ct data (Entering Correct Price Information) during e-procurement process against the RFx and/or Auction is totally the respo nsibility of the Vendor. During e-procurement proce ss (RFx stage and/or Auction) it will not be possible to explain the bidding process to the Vendor. Vendor should ensure all queries and know-how are completed with the help of user manuals and mock/trial auctions a vailable in the SRM portal before the start of e-p rocurement (RFx or Auction) process to ensure smooth participation in RINL’s e-tender/e-auction

1 INSTRUCTIONS TO TENDERERS:

1) Tender shall be submitted in the prescribed form issued by VSP in the RINL SRM Portal, Government P ortal. The Tender documents issued are not transferable. Tender documents downloaded shall be submitted wholly without detaching any part.

2) The Tenderer shall agree to VSPs terms and condi tions, specifications/ scope of work, etc., and quote their Total Amount in figures only. Tender shall be for the entire scope of work mentioned in the tender documents.

2. In case of supply of goods or services o n which the employer (RINL/VSP) is not eligible to avail GST input tax credit, the applicable GST payable by RINL/VSP (in case of unre gistered taxable supplies) or GST to be charged by the registered taxable supplier as applicable, shall be added to the landed cost for evaluation purposes.

4) If by any reason the tender opening is postponed to any other date, the same will be placed in RINL s SRM Portal and in CPPP portal. Tenderers shall see the SRM Portal / CPPP portal regularly and keep themselves informed in this matter.

5) Before quoting, the tenderer shall necessarily c ontact the Engineer and fully understand the job, s cope of work, unit of measurement, mode of measurement, scope of supply of materials by VSP if any, working conditions, shut down arrangements, Labour deployment requirements, risk contingencies and such other factors which may affect their tender.

6) Tenders shall be kept open for acceptance for a period 4 (Four) MONTHS from the date of opening of tender.

7) Corrections/ amendments/ replacement to/ of the Deficient documents submitted, shall not be sought where there is evidence of Tampering/Unauthorized correction

2 EXEMPTIONS / PREFERENCES FOR MSES:

1) EXEMPTIONS / PREFERENCES FOR MICRO AND SMALL ENTERPRISES:

1.1 Micro and Small Enterprises (MSEs) registered u nder Udyam Registration shall be provided exemptio ns / preferences, under this clause, in respect of procurement of goods and services, produced and provided by them (irrespec tive of whether the service is provided within or outside their premises) through the present tender, subject to submission of proo f of registration with Udyam Registration for goods & Services (irrespective of relevance of product category with tendered items) as on the Tender Opening Date (TOD).

Above benefits in terms of exemptions / preferences to MSEs shall not be applicable for the following:- (i) Traders / Distributors / Sole Agent/ Joint Ventures / Consortium.

(ii) Works of “Works Contract” in nature.

Composite contracts, which includes not only supply and / or services but also various other activitie s and obligations under the contract shall be treated as ‘Works Contract’.

1.2 Exemptions : MSE(s) shall be provided exemption from submission of Cost of Tender Documents (CTD) / Tender Processing Fee and Earnest Money Deposit (EMD).

Tender documents shall be downloaded by the tendere r from the websites notified by the company (such as www.vizagsteel.com, www://eprocure.gov.in)

1.3 Purchase Preference: MSE(s) shall be provided Purchase Preference as per the following:

a) MSEs quoting price within the band of L1+15% sh all also be allowed to supply a portion of requirem ent by bringing down their price to L1 price in a situation where L1 price is from someone other than an MSE and such MSEs shall be allowed to supply up to 25% of total tendered value.

b) In case of more than one such MSE, the supply shall be shared proportionately (to tendered quantity)

The MSE(s) eligible for Purchase Preference shall be considered for award of contract, in the order of ranking, as below:

i) MSE(s) owned by SC and ST entrepreneurs till th e value of package(s) considered for award to MSE(s ) (including the L1 tenderer, if MSE ownedby SC and ST entrepreneurs) equals or exceeds 4% of the total value ofwork.

ii) MSE(s) owned by women till the value of packa ge(s) considered foraward to MSE(s) (including the L1 tenderer, if MSE owned by women) equals or exceeds 3% of the total value of work.

iii) Other MSE(s) eligible for Purchase Preference till the value of package(s) considered for award to MSEs (including the L1 tenderer, if MSE) equals or exceeds 25% of the total value of work.

The MSEs desirous of getting preference as per the above clauses (SC and ST owned MSEs or Women owned MSEs) are required to submit the proof of the same along with the tender documents.

The decision of RINL regarding the packages to be c onsidered for awardto MSE(s) shall be final and bin ding. The successful MSE(s) shall ensurethat the registration is valid till end of the contract.

1.4 Payment of bills to the MSE’s shall be made ‘on or before the date agreed upon’ as per the terms & conditions of the contract or within 45 days whichever is earlier, from the date of receipt of bill, completein all respects, by the Engineer in-charge.

Work Desc ENVIRONMENTAL PROTECTION WORKS, BEAUTIFICATION AND HORTICULTURE DEVELOPMENT INSIDE THE PLANT OF VSP.

1 Wherever the replacement work exists, the old items are to be dismantled for fixing the new items. The related connections are to be made good for proper functioning of new items. The rates quoted shall cater for this eventuality unless otherwise stated.The dismantled items are to be Handed over to the Stores.

2 The rates quoted shall be applicable for all works to be carried out at all heights and depths above or below plinth level and location unless otherwise specially stated.

3 The rates quoted shall be deemed to include completion of an item of work as per drawings, specification / relevant IS codes and / or directions of the Engineer. The work may be of intermittent nature. The rates shall be deemed to cater for stoppages due to shutdown / break down, non-availability of front due to operational / safety reasons. No additional payment shall be allowed on account of these.

1.1.0.0 Scope of work:Environmental Protection works, beautification and horticulture development inside the plant of VSP. as defined in the Scope of work

1.2.0.0 Date of start of Contract and Period of Contract : 1.2.1.0 Date of Start of Contract :

1.2.1.1 The date of start of the contract will be reckoned from the date as specified in LOA/WO (Fax-LOA/ LOA/ WO etc.).

1.2.1.2 The agency shall obtain ESI Registration, Labour Licence, required Insurance Coverage Policies for their workmen and Third Party Insurance before start of work/before application for passes for workmen

1.2.1.3 The agency shall start work by obtaining gate passes and safety clearance for the workmen as per date of start specified in LOA/WO(Fax LOA/ LOA/ WO etc.)or otherwise an amount equivalent to 0.10% of awarded value of subject work will be levied as penalty for each day beyond date of start specified in LOA/WO (Fax LOA/ LOA/WO etc.).

1.2.1.4 The latest date of obtaining the ESI Registration, Labour Licence, Insurance Coverages, Gate passes and Safety Clearance will be the actual date of start of work.

1.2.2.0 Period of Contract : 10 (Ten) months from the date of start as specified in LOA/WO (Fax-LOA/ LOA/ WO etc.,)

1.2.3.0 Completion Period:

1.2.3.1 Of old plants, lawns, turfing, beds, hedges etc., within the period of contract as defined above.

1.2.3.2 Of new plants, lawns, turfing, etc., to be developed, one month before expiry of contract.

1.3.0.0 The contract covers planting of trees including decorative and avenue plantation trees, shrubs, establishing lawns, turfing, grass areas, mounds etc., at several places in the plant as directed by engineer-in- charge and as per the specifications and BOQ's

1.4.0.0 The rates quoted for items shall be completed in all respects and shall include the cost of scaffolding, lead, lift, tools, tackles, safety appliances, men and material and wastage, if any. The rates will be applicable to all types of structures at all heights and depths.

1.5.0.0 The tenderer should clearly understand that the work may have to be carried out in hot places, during shutdown and breakdowns as necessary.

The work may have to be carried out round the clock. Shoring, strutting, dewatering etc. may have to be done in order to create front for doing the work. The rates will cover all the above eventualities and no extra claim will be entertained on any account.

1.6.0.0 Period of maintenance (Defect liability period) :

1.6.1.1 ----NIL--- month(s) from the date of Completion as certified by the Engineer-in-charge.

2.0.0.0 RUNNING AND FINAL BILLS

2.1.0.0 The contractor shall submit the Running account bills, Pre and final bills along with challans indicating the details of dispatches, giving the mark numbers along with inspection certificates, entry certificate at the gate issued by CISF and such other documents as may be required by the employer.

2.2.0.0 The Contractor has to submit Royalty Clearance Certificate from AP State Government for the minor minerals consumed for the work. If the contractor fails to submit MRC (Mineral Revenue Clearance), VSP shall recover normal Seigniorage fee with applicable penalty as fixed by the Government from time-to-time, from the bills of the Contractor.

3.0.0.0 SUPERVISION AND SAFETY REQUIREMENTS

3.1.0.0 Agency should deploy at least four(4) experienced horticulture

Supervisors or Specialist to supervise the horticulture jobs covered under this contract.

3.2.0.0 During the time of execution, if any accident happens and during investigation if it was found that the accident was caused due to negligence of safety measures by the contractor, he shall be liable for penalty which will be decided by the employer and the contractor shall pay the penalty

4.0.0.0 TERMS OF PAYMENT

4.1.0.0 The terms of payment for items for hedges, edges, shrubs, trees, climber, shrubbery, ground cover, perennial flower beds, canna beds, roses, annuals, seasonal, potted plants developed during the contract period as per Bill of quantities shall be in percentage basis of the 4.1.1.0 PAYMENT AFTER PLANTATION/ DEVELOPMENT (UNDER THIS SCOPE OF CONTRACT) 4.1.1.1 On completion of planting as per item description against Activity

4.1.2.0 DURING MAINTENANCE PERIOD

4.1.2.1 Maintenance charges will be paid after satisfactory completion of every month maintenance under relevant item (per month per unit)

4.2.0.0 The term of payment for items for lawns, turfing and grass areas of Bill of quantities shall be percentage basis of the accepted contract rate thus:

4.2.1.0 PAYMENT AFTER PLANTATION/ DEVELOPMENT(UNDER THE SCOPE OF CONTRACT) 4.2.1.1 Payment under items for lawns/ turfing and grass areas shall be made

after the area 100 % formed by thick green and fit for mowing and after completion of one month of initial maintenance (No payment shall be made for patchy areas)

4.2.2.0 DURING MAINTENANCE PERIOD

4.2.2.1 For new development of lawns maintenance charges will be paid after completion of one month from the date of completion period for new development of three months as per clause no: 1.2.3.2 of Terms and Conditions

4.2.2.2 Maintenance charges will be paid after satisfactory completion of every month maintenance under relevant item (Per month per sqm) (No payment

4.3.0.0 PENALTY TERMS FOR IMPROPER MAINTENANCE AND DEPLOYMENT OF TOOLS /TACKLES/ MACHINERY ETC.,

4.3.1.0 In case of failure to engage full /part quantity of minimum

requirement of equipments/ hand tools / tackles, penalty amount will

be recovered from the bills at the rates mentioned in the Annexure-I .

4.3.2.0 If the agency has failed to maintain the Plants/ Hedges/ Flower Beds properly during the bill period (Which is not developed under the present contract) the maintenance charges will not be released and an amount equal to the maintenance charges for the defective plants during the bill period as per the quoted rates will be recovered as a NON-REFUNDABLE AMOUNT.

4.3.3.0 If the agency has failed to maintain the Lawns/ Turf areas properly during the bill period (Which is not developed under the present contract) the maintenance charges will not be released and an amount

equal to the maintenance charges for the bad patches/ patchy areas during the bill period as per the quoted rates will be recovered as a

4.3.4.0 If the agency has failed to maintain the Plants/Hedges/Flower Beds properly during the bill period (Which is developed under the present contract) a security deposit equal to cost of initial development and maintenance charges released upto the bill period for those defective plants will be recovered and same will be refunded soon after the completion of rectification or re-plantation in addition to the above maintenance charges for the defective plants during the bill period as per the quoted rates will be recovered as NON-REFUNDABLE AMOUNT.

4.3.5.0 If the agency has failed to maintain the Turf/lawn properly during the bill period (Which is developed under the present contract) a security deposit equal to cost of initial development and maintenance charges released upto the bill period for the bad patches/ patchy areas will be recovered and the same will be refunded soon after the completion of rectification or re-plantation in addition to the above maintenance charges for the bad patches/ patchy of lawns/turfing during the bill period as per the quoted rates will be recovered as NON-REFUNDABLE AMOUNT

4.3.6.0 If the agency has failed to replace the died plants within 15 days as per clause no: 5.6.0.0 of Terms and Conditions of contract a penalty of

` 10.00 per plant per month will be recovered from the running bills as a NON-REFUNDABLE AMOUNT over and above the penalties under clause nos:4.3.2.0 & 4.3.4.0 of Terms and Conditions

5.0.0.0 SPECIFICATION OF HORTICULTURE WORKS 5.1.0.0 GENERAL

5.1.1.0 The contractor should be fully conversant with horticulture work like nature of soil, treatment of soils, usage of manures and fertilizers for different types of plants and shrubs and disease

prevention, treatment after infestation etc., He should engage at least ONE head Mali. Agency should engage the tools and plants required for this work within 15 days of issue of LOA as per list enclosed in Annexure-I (Minimum requirement of equipments, hand tools to be procured by the agency for this work). The agency has to use the sprinklers along with stands at parks as per the requirement and as per the instructions of the site-in-charge. Use of above tools and plant and equipment is compulsory.

5.1.2.0 The agency should maintain and keep in good condition of the existing tap/water points in the parks at his own cost. If any wheel valves/gate valves are damaged during the tenure of contract, it should be replaced/rectified within 15days and the cost of the same is also included in the quoted rates for maintenance jobs for lawns and plants. Further the agency should handover all the tap points in good condition at the end of contract period.

5.1.3.0 The maintenance includes up keeping the plants, watering, weeding, pruning, manuring removal of unwanted vegetation and replacement of withered/ dead plants with good ones from the reserve stock as per Terms &conditions NO: 5.6.0.0 with in 15 days from the date of withering, after reopening the failed pits and retreat the pit as per item description for new tree at no extra cost for both plants

5.1.5.0 The contractor shall deploy their own manpower,materials and equipments for carrying the Horticulture works as stated in specification/BOQ such as water tanker, sprayers, Hedge cutters etc.,

5.1.6.0 The rate for horticulture work shall be inclusive of the cost of seeds, seedlings as specified and all kinds of manure. Plants, fertilizers, good earth, pesticides etc., as required for the work and as enumerated in the items of BOQ. This will also include the cost of deweeding occasionally to keep the lawn and vicinities clean. This will also include the cost of ring bund around plants to retain water and cost of sticks to keep plants upright for the young plants.

5.1.7.0 The good soil is defined as Agricultural soil of loamy texture free from moorum, shingle, stone, brick, building rubbish and other foreign material.

5.2.0.0 PLANTATION OF TREES

5.2.1.0 Pits will be excavated as directed by the engineer, extraneous material will be removed, useful soil and good earth shall be mixed with manure and filled into the pit after planting upto 50 mm below the top surface, watered and dressed. The top soil upto 150 mm is to be stacked separately and while backfilling the pit with good earth/Manure/FYM, the same is to be filled at the top of the pit. For a pit size of 600 mm X 600 mm X 600 mm , the following will be manure and insecticides mix. The top soil upto 150 mm to be stacked

separately and while backfilled the pit with good earth/manure/FYM, the same to be filled at the top of the pit.

5.2.1.1 0.108 Cum of good earth and 0.054 cum of manure to be mixed thoroughly and same should be filled in the pit. On the top of pit available top soil earlier excavated are to be filled. (Quantity

=0.054 cum)

5.2.2.2 0.054 cum of cattle manure or compost,50 gms of DAP,10 gms of BHC 10%

or equivalent and 200 gms of approved oil cake at the time of plantation.

5.2.2.3 Soil around each tree shall be loosened monthly once. During first rainy season after plantation, 50 gms of BHC 10 % or equivalent, 200 gms of approved oil cake and 0.027 cum of rotten cow dung should be

5.2.2.4 The above will be repeated during subsequent rainy seasons if the contract extends that for.

5.2.2.5 The requirement of above dosages will vary depending upon the size of pit thus enumerated in the item description and manure/good earth/pesticides is to be calculated proportionately.

5.2.2.6 Application of FYM/ Fertilizer should be applied at least 300 mm away from base of plant.

5.3.0.0 GRASS AREA AND LAWNS

5.3.1.0 Initially the area shall be dug or ploughed upto a depth of 200 mm thoroughly irrigated and sprouted weeds, stones, foreign material and rank vegetation with roots removed, there form by repeated

forking.Clods of excavated earth shall be broken to smaller size.

The area shall then be flooded with water. After 10 days and within 5 days of flooding, weeds that re-germinate shall be uprooted

carefully. The rubbish shall be disposal of in the manner directed by the engineer.Before the planting of grass to each 100 sqm of the top soil with :--

5.3.1.1 Grass slips selected for planting should be soaked with fungicidal solution.

5.3.1.2 One cum of approved rotten cow dung or form yard manure, 5 kgs of approved Neam oil cake and 2 kgs of BHC 10 % or equivalent should be thoroughly mixed upto a depth of 10 to 15 cms.

5.3.1.3 The grass will be of "DOOB" quality or any other approved quality.

The soil shall be suitable moistened before commencing the operation of planting of grass. The grass will be dibbled to a depth of 6 to 10 cms and 50 mm to 75 mm apart in any direction or other spacing as decided by the engineer. Rolling shall be done with 100 Kg roller once prior to dibbling and once after dibbling.

5.3.2.0 DURING MAINTENANCE PERIOD

5.3.2.1 During the maintenance period, any irregularities arising in ground levels due to watering, or due to walking by labour etc., shall be constantly made upto proper levels with new earth. Constant watch shall be maintained to ensure that died patches are replanted with grass and that weed are removed.

5.3.2.2 During maintenance period of Lawns/Turfing/Grass area 400 gms of DAP per 100 Sqm per annum in split doses shall be added twice during the maintenance period as directed by the engineer. For lawns maintenance neem oil cake decorstion is to be prepared at the rate of 2 kgs of neem oil cake and 10 liters of water and the same should be sprayed over a area 100 Sqm of area and the same treatment should be repeated every month.

5.3.2.3 Deweeding should be taken up after watering and should be removed upto grass root level. If the weeds in the park/areas are more than 60 % then the entire lawn/turf should be replaced with new lawns at the cost of the agency and to be done as per 5.3.0.0 and 5.7.0.0 of this specification.

5.3.2.4 For control of termites spray of TERMEX or CHLOROPHYRIPOS 20 EC (1 % concentration) at the rate of 2.50 Litre per Sqm of the area of the mound.

5.4.0.0 SEASONALS / FLOWER BEDS / CANNA BEDS

5.4.1.0 The beds shall be prepared for planting of seeds/seedlings once in winter season and once in summer season (yearly twice).The soil should be loosened and thoroughly turnover, spreading good earth and

manure/fertilizers etc., form proper medium for growing plants,

during maintenance period 0.175 cum of manure for every 2 sqm of beds area to be spreaded in spilt doses (atleast once in a month) for better growth of plants. On prepared bed, healthy plants/seedlings shall be planted neatly at the rate of 12 to 20 nos per sqm of bed area

depending upon the species. The plants shall be maintained for the full growth and flowering till their life period (for a minimum period of 6 months). As soon as plant shown signs of withering, decaying or dying, such plants shall be uprooted and removed from the bed. The bed shall be prepared again, and new healthy plants of available/ selected / approved variety shall be planted again and maintained

5.5.0.0 HEDGING AND HEDGE PLANT

5.5.1.0 Initially the areas shall be dug upto a depth of 300 mm and weeds and rank vegetation with roots to be removed these from by repeated

forking, stones, brick bats, and other foreign material, if met with during excavation shall be removed and sweet or good earth shall be used for filling the areas.

5.5.1.1 100 gms of oil Cake, 15 gms of sulphate of potash, 50 gms of

ammonium sulphate and 0.040 cum of Manure for every 2 Mtrs, length of hedge plant will be mixed every 6 months and the same treatement should be continued during the maintenance period also.

5.5.1.2 The plant to plant distance will be 20 to 25cms in 2 or 3 staggered rows.

5.6.0.0 REPLACEMENT OF DIED PLANTS

5.6.1.0 The contractor shall stock a minimum of 2 % of the plants covered under scope of the contract or as directed of each species of plants etc., at site, in reserve for replacement of causalities/withered plants etc.,

5.6.2.0 In case of trees planted but withering away, the contractor shall replace such withered plants and casual-ties by good ones of the same age and species from the reserve stock mentioned in the clause no:

5.6.1.0 above, after reopening the failed pits at no extra cost within 15 days from the date of withering

5.7.0.0 TURFING

5.7.1.0 Initially the areas shall be ploughed or dug upto 100 mm thoroughly irrigated and sprouted weeds shall be killed with spraying of

GROMOXINE and weeds, stones, foreign material and rank vegetation with roots removed and the finished formation width should be in level.

Before the setting of turfing, to each 100 sqm of top soil mixed with one cum of approved rotten cow dung or form yard manure and 5 kgs of approved oil cake and 2 kgs of BHC 10 % or equivalent should be thoroughly mixed upto a depth of 40 to 50 mm. The top surface of the ground shall be dressed to the required levels and slopes.Selected Sods of 200/300 mm square blocks of grass should be cut uniformly to 50 to 75 mm thick from the place where the selected grass is free from weeds.

They should be spread on the prepared ground side by side closely and slightly beaten down fast into position. Any cavity or inter spaces should be filled with fine soil and entire turfed area then thoroughly rolled/rammed watered liberally till the turf gets established.

5.7.2.0 The contractor shall be responsible for maintenance of levels and watering, mowing/cutting grass to restrict the height of grass to 50 mm to 75 mm and apply manure as directed by the engineer.

5.8.0.0 WATERING

5.8.1.0 The agency will arrange watering of plants and other elements every day for first 7 days of plantation/ development and once in 2 days during balance period of contract except during rainy season.

However the watering will be more intense in case of lawns, turfing, rose beds and flowering annuals as per requirement.

5.9.0.0 PERIOD OF MAINTENANCE AND PAYMENT OF MAINTENANCE CHARGES

5.9.1.0 All the new development plants, lawns, turfing, hedges etc., in this contract shall be maintained upto the contract period. The rate is inclusive of one month maintenance charges for initial new development period. For all the old plants, lawns, turfing, hedges etc., (Handed over by other agency for maintenance purpose), the period of

maintenance will be upto the contract period..

5.9.2.0 Proportionate recovery on daily basis will be recovered from all the horticultural maintenance items in case of any strike/stoppage of work during maintenance period. The average number of working days per month consider for calculating the daily rate will be 25days

6.0.0.0 GST Clause:

The scope of materials supply and consumables supply in the present proposal are as follows:

TERMS AND CONDITIONS

WORK DESC : ENVIRONMENTAL PROTECTION WORKS, BEAUTIFICATION AND HORTICULTURE DEVELOPMENT INSIDE THE PLANT OF VSP.

Cond No Cond Desc 7.1.2.0 NOTE:

1)The above equipment, tools and tackles m e n t i o n e d i n 7 . 1 . 1 . 0 shall be procured by the contractor within the mobilisation period of 15 days to site.

2)(**) In case of failure to procure the minimum requirement, penalty amount will be recovered from the RA Bills at the rates mentioned in the above statement.

3)(##) Penalty will be imposed proportionately per day, when the agency has failed to engage the water tanker as and when required and as per instructions of engineer-in-charge.

8.1.1.0 On the principle that the polluter must pay, if any negligent act of the contractor results in pollution of the land/ air/ water or affects any persons health adversely, then the contractor shall have the obligation to suitably remedy the pollution or health impairment caused, to acceptable standards, failing which the VSP management shall effect necessary recovery for the bills of the contractor and remedy the pollution/ health impairment caused.

8.1.2.0 The following environment,safety & health points are to be adhered : a) The contractor must adhere to all the applicable statutory laws

pertaining to safety, health and environment.

b) The contractor must ensure that there is no wastage of water at the work site The contractor must also ensure that all the water tapping points are leak proof.
