Minutes of the meeting held on dated 24.01.2022 at DC Office, Bhiwani in compliance of Hon'ble NGT order dated 03.01.2022 in OA No. 01 of 2022 as the Indian Express Newspaper dated 02.01.2022 titled "Four killed in Haryana mine Landslide.

Brief note about the case

An accident occurred in the mine lease area of M/s Govardhan Mines &

Mineral, Village Dadam, Bhiwani on dated 01.01.2022 and the news published in the Indian Express Newspaper on dated 02.01.2022 titled as "Four killed in Haryana mine Landslide". The Hon'ble National Green Tribunal taking cognizance of the said news item has considered suo moto case on 03.01.2022 i.e. OA No. 01 of 2022 as the Indian Express Newspaper dated 02.01.2022 titled "Four killed in Haryana mine Landslide. The Hon'ble NGT in the above mentioned OA has constituted an eight members joint committee comprising of nominee of MoEF&CC, CPCB (Regional office, Chandigarh), National Disaster Management Authority, GoI, Director General of Mines Safety, GoI, PCCF(HoFF), Haryana, SEIAA, Haryana, State PCB and District Magistrate, Bhiwani to ascertain the extent of violations, extent of damage to the environment and to the human life, extent of compensation paid and payable, safety precaution taken to prevent recurrence of such happenings in future by the PP and the statutory regulators. The operative part of the order is reproduced as under:-

"Having regard to the incident reported in media, resulting in loss of lives and injuries, it is necessary to constitute eight member joint Committee comprising of nominees of MoEF&CC, CPCB (Regional office, Chandigarh), National Disaster Management Authority, GoI, Director General of Mines Safety, GoI, PCCF(HoFF), Haryana, SEIAA, Haryana, State PCB and District Magistrate, Bhiwani. The CPCB and State PCB will act as nodal agency for coordination and compliance. The joint committee may meet within two weeks, undertake visit to the site and interact with the stakeholders. Except visit to the site as and when necessary, other proceedings may be conducted online, if necessary. The Committee may ascertain the extent of violations, extent of damage to the environment and to the human lives, extent of

compensation paid and payable, safety precautions taken and required to be taken, steps to prevent recurrence of such happenings in future by the PP and the statutory regulators. The report may be furnished within two months by email by e-mail at judicial-ngt@gov.in preferably in the form of searchable PDF/ OCR support PDF and not in the form of image PDF, A copy of the report also be hosted on the website of CPCB, to enable the PP to furnish its comments, if any, before the next date. The Committee may consider such earlier reports of committees in respect of accidents due to violation of safety norms, in recent past, available on the website of the CPCB."

Therefore, In compliance of the order dated 03.01.2022 passed by Hon'ble NGT in the matter of OA No. 01 of 2022 as the Indian Express Newspaper dated 02.01.2022 titled "Four killed in Haryana mine Landslide, a meeting was held on dated 24.01.2022 at 11:30 AM through VC with the members of Joint Committee constituted by Hon'ble NGT. The attendance sheet is enclosed herewith as Annexure-1 The minutes of the meeting are as under:-

At the very outset of the meeting the Regional officer of HSPCB, Bhiwani welcomed all the committee members constituted by Hon'ble NGT and officers of the stake holder departments. Thereafter, he briefed that the Hon'ble NGT has taken cognizance of the accident occurred in the mining lease area of M/s Govardhan Mines & Mineral, village Dadam, Bhiwani and taken suo-moto of the news item published in Indian Express dated 02.01.2022 titled as " Four killed in Haryana mine Landslide at Haryana". Thereafter, he also briefed about the history of case already pending before on Hon'ble NGT and the Mining Project M/s Goverdhan Mines & Mineral, Dadam, Bhiwani. After detail deliberation on the issues the following decisions were taken :-

 That the Regional officer, HSPCB, Bhiwani shall provide all the available documents pertaining to the Mining Project M/s Goverdhan Mines &

Mineral, Dadam, Bhiwani to all the members of Joint Committee

 That the Regional Officer, HSPCB, Bhiwani shall provide the all necessary documents pertaining to the OA No. 132 of 2020 titled as Kuldeep Singh Vs HSPCB & ors. for perusal of the Joint Committee.

 That all the stake holder departments i.e. Mining Department, Forest Department, Mines & Safety Department, Revenue Department etc shall provide all the related documents to the Regional office, HSPCB, Bhiwani.

 During the meeting Sh. A.K. Dass, nominee of DGMS, Ghaziabad informed that the project proponent has already mined almost upto the lease boundary in pit no. 37 & 38 where the accident occurred on 01.01.2022. and it is not practically feasible to create benches for extraction of mineral from this pit at this stage.

 Dr. Ravinder Singh nominee of NDMA has suggested that representative of Geological Survey India may also be made the members of the Joint Committee.

 Sh. A.K. Dass, nominee of DGMS, Ghaziabad informed that out of the total 05 nos. diseased persons, the compensation of Rs. 15.70 laces to one person & compensation @ the rate of Rs. 15 laces to each of the remaining four diseased persons and compensation @ the rate of Rs.

02 laces each to all the injured persons has already been paid by the Project Proponent.

After detailed deliberation on the matter Dr. Suneel Dave nominee of CPCB suggest that in order to ascertain the extend of violations and damage caused due the accident a field visit of the Joint Committee alongwith stake holders departments is necessary and it has been decided with the consent of all the members to visit the site on 04.02.2022 at 11:0 AM onwards.

Later on Mr. R.K. Sapra, member representing SEIAA has informed that the period of SEIAA is expiring on 28.01.2022 and reconstitution of the Authority is due on January 29,2022. It is expected that he could continue as member of this Committee unless and otherwise there is change made by the SEIAA for this Committee.

Mr. A.K. Dass, nominee of DGMS suggested to make the visit of the site after February 10, 2022 as he is expected to be deputing for election duty.

However, as agreed by other members, the date of visit is kept as February 4,2022. In case Mr. A.K. Dass is not able to make it then he will let this Committee to know the observations based on the visit made by him on later date.
