TS-iPASS - Rules - Telangana State Industrial Project Approval and Self Certification System (TS¬iPASS) Rules, 2015 — Amendments — Issued

Read the following:

1. Telangana State Industrial Project Approval and Self Certification System (TS-iPASS) Act, 2014 (Act No. 3 of 2014)

ORDER:

In exercise of powers conferred under sub-section (1) of Section 26 of the Telangana State Industrial Project Approval and Self Certification System (TS-iPASS) Act, 2014 (Act No.3 of 2014), Government has issued Telangana State Industrial Project Approval and Self Certification System (TS¬iPASS) Rules , 2015 vide reference 3rd read above for implementation of the provisions of the said Act.

2. In order to facilitate the investors by providing investor friendly environment, Government further issued certain amendments vide reference 4th read above to Telangana State Industrial Project Approval and Self Certification System (TS-iPASS) Rules, 2015 issued in G.O. 3rd read above, suitably to strengthen the powers of Telangana State Industrial Project Approval and Self Certification System (TS-iPASS) Committees at State Level and District Level as specified in the said rules.

3. To further facilitate the investors in establishment and operation of their unit and to mandate time-bound delivery of all services provided by the Government to Industries /Business with the objective of improving the Ease of Doing Business in the state, Government after careful examination decided to include 34 services under the purview of TS-iPASS.

4. Accordingly, the following amendments are issued to the TS-iPASS Rules(amended from time to time) to authorise the Government for making any changes in the Common Application Form(CAF), for mandating ONLINE application, for modification of the penalty amount and for including additional services in the Annexure VI of the rules:

AMENDMENTS

1) In Rule 5, clause (c) shall be substituted with “The Combined Application Form duly filled in shall be submitted by attaching the relevant enclosures, certificates, attachments, fees, etc., through ONLINE”

2) The following shall be included as Rule 5(g) after 5(f) in Rule 5:

“(g). The Combined Application Form may be revised by the Government as and when required”.

3) In rule 6, the expression “(online or otherwise)” shall be deleted 4) The existing rule 10 shall be substituted by the following, namely:-

The time limits for various clearances shall be as prescribed in Annexure VI, provided these applications were complete in all respects at the time of their submission and there are no further information/query pending and where the granting of approval is not held up for want of clearances from agencies/departments/institutions other than those of the state government. The government may notify the clearances in respect of which the failure of the competent authority to pass final orders on the application within the stipulated time shall result in deemed approval. Certificate so issued to the units shall be binding on all concerned departments.

5) In annexure –IV “Processing Fee to be paid in the form of DD favouring

"Commissioner of Industries, Hyderabad" or to be paid online (see

directions) Head of A/c for Challan : 0851-Village and Small Industries, MH- 102 Small Scale Industries, SH (81)-Other Receipts, 800-User Charges DDO Code 25001305001 ” - shall be deleted

6) In the Annexure VI, under TIME LIMITS – ESTABLISHMENT the entry at S No.

2 (a) i.e. “NOC from Polluting Angle for Green Category Units” issued by District Industries Centre” - shall be deleted.

7) In the Annexure VI, under TIME LIMITS – ESTABLISHMENT the entry at S No.

2 (b), (c) and (d) i.e., “CFE” shall be replaced by “CFE (under Water Act 1974 and Air Act 1981)”

8) In the Annexure VI, the entry at S.No. 8 i.e., “HMDA and KUDA” shall be replaced by “HMDA, KUDA and DTCP”

9) In the Annexure VI, the entry at S.No. 12 i.e., “HMWS&SB” shall be

replaced by “HMWS&SB, Irrigation & CAD Department, CDMA, PR&RD, I&C, RWS, GHMC”

10) In the Annexure VI, under TIME LIMITS FOR OPERATION the entry at S No. 1 (a), (b) and (c) i.e., “CFO” shall be replaced by “CFO (under Water Act 1974 and Air Act 1981)”

11) In the Annexure VI, under TIME LIMITS – OPERATION the entry at S No. 6 i.e., “Drug License” shall be replaced by “Drug Manufacturing License”

12) The following rule shall be added after rule 18, 19: Inspection Guidelines

a) Municipal Administration & Urban Development, Industries & Commerce, Panchayat Raj & Rural Development and Consumer Affairs, Food and Civil Supplied dept. to ensure following, for services mentioned at Sl. No. 24, 25 and 26 under other services:

i. Allocation of inspectors shall be through a computerized system and inspection report should also be made available on TSiPASS website with provision to view / download from TSiPASS website.

ii. Computerized inspector allocation shall be designed in such a way that same inspector will not inspect the same establishment twice consecutively.

13) In the Annexure VI

(i) Under “TIME LIMITS –ESTBALISHMENT” after the entry at Sl.no.21, the following entries shall be added:
