: CONSIDERATION OF THE RECOMMENDATIONS OF THE STANDING ESTABLISHMENT-CUM-GRIEVANCE COMMITTEE MADE AT ITS ADJOURNED MEETING HELD ON 07.9.2016.

The Standing Establishment-cum-Grievance Committee at its adjourned meeting held on 07.9.2016 had considered appeals preferred to the Executive Council under Section 36(B) of the Aligarh Muslim University Act XL of 1920 (as amended upto 1981). The recommendations of the Committee are placed at the Appendix for consideration of the Executive Council alongwith a copy of the orders dated 26.8.2016 of the Hon'ble High Court of Judicature at Allahabad in Contempt Application (Civil) No. 4236 of 2016, Mohd. Quasim and 2 Others Vs. Vice-Chancellor/Chairman, Executive Council, A.M.U (Reference:

Item No.11: To consider the Appeal dated 02.09.2015 filed by Dr. Tazin Iqbal, retired Primary Teacher under Section 36(B} against the orders of the Executive Council communicated vide Office Memo No.1966/GC/2015 dated 09.06.2015 regarding Condonation of break in her service. I

The Committee examined the request of Dr. Tazin Iqbal, retired Primary Teacher, AMU Girls School and found that the total period of. service as Temporary Primary Teacher/TGT and permanent Primary Teacher as work out 11 Years 03 Months and 8 days as per recommendations of the VI Pay Commission. She is entitled for pensionary benefits for the aforesaid period.

The break-up of this calculation has been worked out after elimination of the break in service rendered as part-time Teacher. The period of service rendered as Part-Time teacher is hereby condoned for the purpose of pensionary benefits.

Item No.12: To consider the Appeal dated 21.03.2016 filed by Mr. 5anat Yar Khan, under Section 36(8) against the orders of the Vice- Chancellor communicated by the Proctor vide Office .Memo NO.3916/Proc. Dated 21.12.2015.

The case of Mr. Sanat Yar Khan, Ex-Student of B.Tech. (Mechanical, II Year), A.M.U.

was considered. It was revealed that there has been no material change since the verdict of the disciplinary Committee held on 05.12.2015. The matter does not merit any review. The appeal is rejected.

Item No.13: To consider the joint mercy appeal filed by MIs Jaideep Yadav, Mohd. Qasim, Mohd. Arif ci Mohd. Aslam students of Ahmadi School for Visually Challenged against of the Vice-Chancellor communicated by the Proctor vide Office Memo No.3917/Proc.

Dated 21.12.2015.

The case of the following Ex-Students of Ahmadi School for the Visually Challenged were considered.

A. Mr. Mohd. Qasim, Class-IX

B. Mr. Jaideep Yadav Class-X

C. Mr. Mohd. Atif Class-IX

D. Mr. Mohd. Arif Class-VIII

E. Mr. Mohd. Aslam Class-VII

The events in the night of

September, 2015 which led to action against these five students were discussed. There is no doubt that the students behaved in-the most violent and vindictive manner without any provocation from the School authorities. The amount of damaged which they inflicted was colossal. Itincludes total destruction of CCTV Cameras, one complete computer system, Braille machine, electric fitments, personal Car of the Principal, broken window glases, Flower Pots and confidential records containing their undertakings for good behaviour at the time of admission and leading a mob of students to attack at the residence of the Principal at the dead night warrants no remission in punishment.

It has been ascertained from the School Principal, that these students have been perpetual problem creators and notwithstanding the apology rendered for their behaviour, it is unlikely that they will improve their conduct in future.

The Committee is, therefore, of the view that the sentence passed by the disciplinary Committee and confirmed by the Vice-Chancellor merits no remission and punishment commensurates with their malicious deeds. Any mitigation of punishment will be detrimental to the disciplinary Committee and running of the Schoo! in future.

The appeal is therefore, set aside.

Item No.14: To consider the appeal of Prof. Songeeta Singhal, Department of Physiology dated 14.11.2015 under Section 36(8) of Aligarh Muslim University Act 1981 against the appointment of Prof. Rajiv Gulati as Chairman, Department of Physiology.

The appeal of Prof. Sangeeta Singhal, Department of Physiology was considered in the light of the recommendations of the Committee constituted by the Vice-Chancellor for framing the rules for governing of redetermination of seniority (Notional) of Professor promoted under Old CAS Scheme (V Pay Commission) and new CAS Scheme under (VI Pay Commission). The Committee has made certain recommendations which do not categorically resolve the contention of neither appellant nor respondent.

In view of above, the Grievance Committee recommends that the matter be taken up before the Executive Council as a full-fledged agenda item for resolving this appeal and other similar cases. If needed the Executive Council may constitute a Committee to examine this issue and give its specific recommendation.

Item No.15: To consider the requet of Mr. S. Noqi Imam Naqvi, Sr. Lob Assistant (Retd.) , Department of Microbiology, .I.N.M.Coliege to re-designate his post of Senior Lab Assistant as Senior Technical Assistant on the analogy of Mr. S. A. A. Naqvi, Department of Mathematics and -Seven others.

The matter was deferred with the direction that all the relevant documents pertaining to the case alongwith communication with UGCbe placed before the Committee.

The Committee also directed the detail of similar cases which have been cited by the appellant be also placed so as to draw parity for up gradation.

The Pro-Vice-Chancellor declared the meeting as closed and the Registrar proposed a vote of thanks to the members for their participation in the deliberations.

Heard Sri Rajesh Kumar Singh, learned counsel for the applicants.

It is submitted that despite effecting personal service of the certified copy of order dated 4.3.2016 passed by this court in Writ Petition No.l0489/2016 along with representation, in the office of the opposite party on 23.6.2016, followed by reminder dated 7.5.2016, by which he was directed to decide tile statutory appeal filed by the applicants, but till date no order whatsoever has been passed in the pending appeat. which is in wilful / deliberate disobedience of the order of the VVritCourt.

Prima facie, a case of contempt is made out against the opposite party.

Issue notice to the opposite party.

List on 7.11.2016. Opposite party need not appear at this stage.

The counter affidavit may be filed within the aforesaid period or else charges may be framed after summoning the noticee.

Item No.5 TO RE-CONSIDER THE APPEAL FILED UNDER SECTION 36(B) OF THE A. M. U. AMENDMENT ACT XL OF 1920 BY MR. MAZHAR MUSTAFA, SEMI PROFESSIONAL, C.E.C. IN PURSUANCE OF THE ORDER OF THE HON'BLE HIGH COURT JUDICATURE AT ALLAHABAD DATED 15.9.2016 PASSED IN THE WRIT - A NO.43876 OF 2016.

The Executive under Item No. 7 at its ordinary meeting held on 28.5.2016 considered the Appeal filed under Section 36(B) of the A.M.U. Amendment Act XL of 1920 by Mr. Mazhar Mustafa, Semi Professional, C.E.C.in pursuance of the order of the Hon'ble High Court of Judicature at Allahabad dated 02.12.2015 passed in the Writ Petition No.65329 of 2015 and rejected the same because the existing rules do not permit. A copy of complete text of agenda item No.7 of E.C. dated 28.5.2016 alongwith Resolution is placed for perusal at Appendix.

The Hon'ble High Court of Judicature at Allahabad in Writ -A No. 43876 of 2016 Mr. Mazhar Mustafa Vs. A.M.U. and 2 ors. has passed as under (Appendix) :_

"This petition is directed against the decision taken by the Executive Councilin its meeting held on 28 May 2016 in regard to the appeal that was filed by the petitioner under Section 36(B) of the Aligarh Muslim University Act, 1920, as

amended from time to time. .

The petitioner had earlier filed a writ petition bearing No. 65329 of 2015 in this Court allegingthat he was workingas a Semi Professional in MaulanaAzad Library of the University but as there were some artificial breaks in his service, they should be condoned. The petitioner had for this relief filed an appeal before the Executive Counciland this Court disposed of the writ petition that was filed by the petitioner with a direction to the Executive Councilof the University to take a decision within three months.

The Office of the Registrar has on 6 June 2016 notified the extract of the minutes of the meeting of the Executive Councilon 28 May 2016, in which a decision was taken on the appeal. They are as follows :-

"EXTRACT FROM THE MINUTES OF THE ORDINARY MEETING OF THE EXECUTIVE COUNCIL HELD ON 28.5.2016

Item No. 07 : To consider the Appeal filed under Section 36(B) of the AMU Amendment Act XL of 1920 by Mr. Mazhar Mustafa, Semi ProfeSSional, C.E.C. in pursuance of the order of the Hon'ble High Court of Judicature at Allahabad dated 02.12.2015 passed in Writ Petition No. 65329 of 2015.

The house considered the Appeal filed under Section 36(B) of the AMU Amendment Act XL of 1920 by Mr. Mazhar Mustafa, Semi Professional, C.E.C.in pursuance of the order of the Hon'ble High Court of Judicature at Allahabad dated 02.12.2015 passed in Writ Petition No. 65329 of 2015 and rejected the same because the existing rules do not permit."

It is submitted by learned counsel for the petitioner that all that has been stated in the Resolution of the Executive Council is that the appeal was against the eXisting rules and rejected "the same because the eXisting rules do not permit". The Resolution of the Executive Council is absolutely vague.

It does not indicate as to whether the claim of the petitioner was against the rules or whether the appeal that was filed was against the rules. In any case, the claim of the petitioner was required to be decided by a speaking and reasoned order. The Executive Council has not even considered the grievances raised by the petitioner in appeal and in one sentence has rejected the appeal "because the eXisting rules do not permit".

Sri Ikram Ahmad, learned counsel for the respondent University, has however, made an attempt to justify the order on the basis of the rules.

We are not inclined to accept the justification for the simple reason that the Executive Council was required to give reasons. We, therefore, find it difficult to sustain the decision taken by the Executive Councilat Item No.7 in the meeting held on 28 May 2016.

We, accordingly, quash the decision taken by the Executive Counciland direct the Executive Councilof the University to take a fresh decision in accordance with law and by a speaking order expeditiously and preferably within three months from the date a certified copy of the order filed by the petitioner before the Chairman of the Executive Council.

The writ petition is, accordingly, allowed to the extent indicated above."

In view of above orders dated 15.9.2016 of Hon'ble High Court of Judicature at Allahabad, the Appeal filed under Section 36(B) of the A.M.U.

Amendment Act XL of 1920 by Mr. Mazhar Mustafa, Semi Professional, C.E.C.

is placed before the Executive Council for its re-consideration (Appendix).

Amendment Act XL of 1920 by Mr. Mazhar Mustafa, Semi Professional, C.E.C. in pursuance of the order of the Hon'ble High Court Judicature at Allahabad dated 02.12.2015 passed in the Writ Petition No. 65329 of 2015.

Mr. Mazhar Mustafa, Semi Professional, C.E.C. submitted an application dated 10.01.2008 addressed to the Registrar requesting for Condonation of break in his service for all purposes that is for the purpose of continuity, Pensionary benefits and house allotment etc. (Annexure-I).

The request of Mr. Mazhar Mustafa was considered by the Standing Committee at its meeting held on 13.02.2012 where in he was allowed only Pensionary benefits 1 house allotment and not the continuity in service. The recommendation of Standing Committee were considered and duly approved by the Executive Council at its meeting held on 29.09.2012 under Item No. 30.

Accordingly an office memo was issued on 17.12.2012 vide D.No.863/GC/2012 (Annexure-n).

The said Mr. Mazhar Mustafa after issuance of the aforesaid Office Memo submitted two more applications dated 19.01.2013 & 26.05.2014 addressed to the Pro-Vice-Chancellor against the aforesaid decision of the Executive Counciland requested for continuity in service too (Annexure-III).

The matter of Mr. Mazhar Mustafa was again placed before the Standing Committee Chaired by the Pro-Vice-Chancellor at its meeting held on 06.01.2015 and the committee decided as under:

''Continuitycould not be acceded to. Pensionarybenefits have been allowedvideD.No. 863/GC/2012dated 17.12.2012"

Apart from the above recorded decision, the Committee observed +that request for continuity may not be taken up at this stage as firstly it was time barred and secondly the duration of break for which the continuity was sought was more than one year period hence was not tenable in terms of provision of Chapter - IV relating to Condonation of break in service particularly clause 23 (i)(b) and 23 (2) of the Ordinances (Executive).

The above decision of the Standing Committee was placed before the Executive Council. The Executive Council at meeting held on 22.05.2015 under item no. 06 considered arid approved the recommendation of the Standing Committee. The decision of the Executive Council was communicated to all concerned including Mr. Mazhar Mustafa vide Office Memo D. No.

1766/GC/2015 dated 08/09.06.2015 (Annexure-IV).

Having aggrieved by the above decision of the Executive Council communicated vide Office Memo dated 08/09.06.2015, the said Mr. Mazhar Mustafa preferred an appeal under Section 36(B) of the AMU Amendment Act to the Chairman,Executive Council for giving continuity in his service (Annexure- V).

It is to be mentionedhere that the Standing Committeewhich look into the cases of Condonationof break in service is a Sub-Committee which has been constituted by the Executive Council. The Standing Committee consideredsuch cases and submit its recommendationfor the consideration of the Executive Counciland after consideration and approval of the recommendationsof the Standing Committeeby the Executive CouncJ1,the final orders are issued.

In the present case Mr. Mazhar Mustafa submitted his first request for Condonationof break in service on 10.01.2008.His request was examined by the CondonationCommittee in its meeting held on 13.02.2012and it was found that the break period was more than six months, hence continuity was not allowed.

However the University taking a sympathetic view, allowed him Pensionary benefits and Houseallotment (Annexure-VI).

It is further pointed out that having been communicatedthe decision of the Executive Council which considered the recommendation of the Standing Committee at its meeting held on 13.02.2012 vide office memo D. No.

863/GC/2012 the said Mr. Mazhar Mustafa as stated earlier submitted two applications to the Pro-Vice-Chancellor being the chairman of the Standing Committee. Both the applicationsof Mr. Mazhar Mustafa, are time barred nowas the application for Condonationof break in service for the purpose of giving continuity should have been submitted within two years from the date of placementon probation in service in terms of Sub-clause(2) of Clause23 of the Chapter IV of the Ordinances (Executive). However the applications of Mr. Mazhar Mustafa were againplaced before the Standing Committee which was chaired by Pro-Vice-Chancellorat its meeting held on 06.01.2015. The decision taken by the Standing Committee has already been cited above which was considered and approved by the Executive Council at its meeting held on 22.05.2015 under item no. 06. The decision of the Executive Council was communicatedto Mr. Mazhar Mustafa vide office memoD.No. 1766/GC/15.

It is further pointed out that the applications for Condonationof break in service has already been decided by the Executive Council twice that is on 29.09.2012 and 22.05.2015, therefore the appeal preferred by Mr. Mazhar Mustafa has no force.

However, Mr. Mazhar Mustafa instead of waiting the outcome on his aforesaid appeal has straight away approached the Hon'ble Allahabad High Court for seeking redressal of his grievance by filing a Writ Petition No. 65329 of 2015. The University Standing Counsel who was not aware of the facts of the case of Mr. Mazhar Mustafa, before the Hon'ble Allahabad High Court contended that appellate authority is executive council of Aligarh Muslim University, Aligarh and appeal as per power so conferred, has been filed on 17.06.2015 under Section 36-B of Aligarh Muslim University Act and all attempt and endeavour would be made to decide the appeal in the next meeting of the Executive Council.

In view of the above contention of the University's Standing Counsel the Hon'ble Allahabad High Court has ordered that appeal preferred on behalf of the petitioner would be taken up and decided by the Executive Council provided it is in the requisite format in the next meeting, in accordance with law (Annexure- VII).

Accordingly the appeal preferred by Mr. Mazhar Mustafa is submitted for kind consideration and orders of the Executive Council as may be deemed fit keeping in view of the fact that the Executive Council has already approved the recommendations of the Standing Committee at its earlier meeting held on 29.09.2012 under item No. 30 and on 22.05.2015 under Item No. 06 and decision of the Executive Council have already been communicated to Mr. Mazhar Mustafa.

Matter for consideration

To Consider the Appeal filed under Section 36(B) of the AMU Amendment Act XL of 1920 by Mr. Mazhar Mustafa, Semi Professional Assistant in C.E.C. in pursuance of the order of the Hon'ble High Court Judicature at Allahabad dated 02.12.2015 passed in the Writ Petition-A No. 65329 of 2015 taking into consideration that the Executive Council has already approved the recommendations of the Standing Committee at its earlier meeting held on 29.09.2012 under item No. 30 and on 22.05.2015 under Item No. 06 and decision of the Executive Council have already been communicated to Mr. Mazhar Mustafa.
