1 The issue for consideration is the remedial action against illegal constructions in the buffer zone of Kudlu Chikka Kere Lake in

Bangalore South, Karnataka and maintenance of the lake by controlling polluting activities.

2 Vide order dated 16.01.2019, a report was sought jointly from the District Magistrate, Bangalore South and the Karnataka State

Pollution Control Board (KSPCB).

3 The matter was considered further on 02.07.2019 in the light of the report dated 29.06.2019 acknowledging illegal constructions and discharge of sewage.

Accordingly, the Tribunal directed taking of

remedial action and furnishing a further action taken report.

4 Report filed on 09.12.2019 gives the status of the action taken which include issuance of notice to the inhabitants against dumping of garbage and discharge of waste water. 28 constructions have been identified in the buffer zone.

5 Let further status report be filed about the removal of illegal constructions /encroachments and preventing garbage and sewage which may also include analysis of the water quality of the lake at different locations. The report may be filed before 28.02.2020 by email at judicial-ngt@gov.in.

As per the Hon’ble NGT directions dated 2-07-2019, the BBMP along with Tasildhar Anekal and Assistant director of Land Records

surveyed the Buffer zone of 30m of Kudlu Chikka kere and

identified the 28 structures located in the Buffer zone. Accordinly the Assistant Executive Engineer Begur Sub Division who is the delegated authority of Commissioner BBMP to issue notices under section 308 of KMC act had issued notices and the same was reported as compliance during the last date of hearing.

In response to the notices the owners of 25 structures have submitted their reply stating that they have put up the

constructions long back when the area was under the purview of Gram Panchayat Kudlu Village enclosing the relevant documents.

The other three owners failed to submit their reply have been issued further notices under Karnataka Municipal Corporation Act 1976 the detailed statement with the name, address along with

documents submitted by the owners has been enclosed as Annexure-1.

As per the kind directions BBMP has requested CSIR-National Environmental Engineering Research Institute to inspect and to assess the lake water quality. The NEERI has submitted the report of the lake water quality the same has been enclosed as

Annexure-2.for the kind perusal.

The BBMP further issued notices dated 14-02-2020 under rule 4 (2 of SWM rule 2016 to the owners prohibiting dumping/ throwing of garbage in and around Kudlu Chikka kere the notices 17-01-2020 the copies of the notice issued are enclosed as Annexure-3 & 4.
